the Grand Jurors, chosen, selected and sworn, in and for
the County of Saline in the name and by the authority of the People of
the State of Illinois, upon their oaths present: That ELIJAH PIERSON
late of said County, on the thirtieth day of May in the year of our Lord
one thousand eight hundred and ninety three at and in the County aforesaid
with force and arms in and upon the body of one JONAH DORRIS, in the peace
of the said People then and there being did then and there unlawfully willfully,
feloniously and of his malice aforethought make an assault and that the
said Elijah Pierson a certain pistol then and there charged with gunpowder
and leaden balls which said pistol he the said Elijah Pierson in his hands
then and there had and held then and there unlawfully, willfully, feloniously
and of his malice aforethought did shoot off and discharge to against and
upon the said Jonah Dorris and that the said Elijah Pierson with the leaden
balls aforesaid and of the pistol aforesaid then and there by force of
the gun powder aforesaid by the said Elijah Pierson, shot off and discharged
as aforesaid then and there unlawfully willfully feloniously and of his
malice aforethought did strike penetrate and wound him the said Jonah Dorris
in and upon the right breast of him the said Jonah Dorris giving to him
the said Jonah Dorris then and there with the leaden balls aforesaid so
discharged as aforesaid and shot out of the pistol aforesaid by the said
Elijah Pierson in and upon the right breast of him the said Jonah Dorris
one mortal wound of the depth of ten inches and of the breadth of one inch
of which said mortal wound he the said Jonah Dorris then and there instantly
died. And so the Grand Jurors aforesaid upon their oaths aforesaid
do say that the said Elijah Pierson him the said Jonah Dorris in manner
and form aforesaid on the day and year last aforesaid at the County aforesaid
unlawfully willfully feloniously and of his malice aforethought did kill
and murder contrary to the form of the statute in such case made and provided,
and against the peace and dignity of the said People of the State of Illinois.
