State of Illinois, Saline County, Of the November Term of the Saline Circuit Court, in the year of our Lord one thousand eight hundred and seventy six.  The Grand Jurors chosen selected and sworn, in and for the County of Saline, in the name and by the authority of the People of the State of Illinois, upon their oaths present:  That George Elliott, late of said County, on the twenty fourth day of December in the year of our Lord, one thousand eight hundred and seventy six, at and in the County of Saline aforesaid with force and arms, in and upon the person of one  CHARLES PICKETT, unlawfully, feloniously and of his malice aforethought, did then and there make an assault; and that the said George Elliott a certain pistol, then and there loaded and charged with gun powder and one leaden bullet, which pistol he the said George Elliott in his right hand then and there had and held, to against and upon the said Charles Pickett, then and there feloniously, willfully and of his malice aforethought did shoot and discharge; and the said George Elliott, with the leaden bullet aforesaid, out of the pistol aforesaid, then and there by force of the gun powder shot and sent forth as aforesaid, the said Charles Pickett; in and upon the head of him the said Charles Pickett, a little above the ear of him the said Charles Pickett, then and there, feloniously, willfully, and of his malice aforethought, did strike, penetrate, and wound, as aforesaid, shot, discharged and sent forth out of the pistol aforesaid, by the said George Elliott, in and upon the head of him the said Charles Pickett, a little above the ear of him the said Charles Pickett one mortal wound, of the bredth of one inch and of the depth of six inches, of which said mortal wound, the said Charles Pickett, then and there instantly died; and so the jurors aforesaid, upon their oaths aforesaid, do say, that the said George Elliott, the said Charles Pickett in a manner and form aforesaid, feloniously, willfully and of his malice aforethought did kill and murder, contrary to the form of the statute in such case made and provided and against the peace and dignity of the People of the State of Illinois.--James M.
