the Grand Jurors, chosen, selected and sworn, in and for
the County of Saline in the name and by the authority of the People of
the State of Illinois, upon their oaths present: That John Neil late
of said County, on the first day of July in the year of our Lord one thousand
eight hundred and ninety nine at and within the said County of Saline in
the State of Illinois, aforesaid, with force and arms in and upon the body
of one CECIL WILLIFORD in the peace of the People then and there
being did then and there unlawfully, willfully, feloniously and of
his malice aforethought make an assault and that the said John Neil, a
certain pistol then and there loaded with gunpowder and a leaden ball which
said pistol the said John Neil in his hand then and there had and held
then and there unlawfully and willfully feloniously and of his malice aforethought
did discharge and shoot off to against and upon the said Cecil Williford
and that the said John Neil with the leaden ball aforesaid out of the said
pistol, aforesaid did, then and there by the force of the gunpowder aforesaid
by the said John Neil discharged and shot off as aforesaid then and there
unlawfully, willfully and of his malice aforethought, did strike penetrate
and wound him the said Cecil Williford in and upon the left side of him
the said Cecil Williford giving him the said Cecil Williford then and there
with the leaden ball, aforesaid so discharged as aforesaid, and shot out
of the said pistol aforesaid by the said John Neil aforesaid in and upon
the left side of him the said Cecil Williford, one mortal wound, of the
depth of six inches and of the breadth of one half inch of which said mortal
wound he the said Cecil Williford then to wit on the third day of July
in the year of our Lord one thousand eight hundred and ninety nine and
there died, and so the Grand Jurors aforesaid upon their oaths aforesaid
do say that the said John Neil him the said Cecil Williford in manner and
form aforesaid on the day and year aforesaid at the County aforesaid unlawfully
willfully feloniously and of his malice aforethought did kill and murder
contrary to the form of the statute in such case made and provided, and
against the peace and dignity of the said People of the State of Illinois.
